メニュー Skip to primary content ホーム プラトン全集読破ポータル 検索 Narimasu_0717 Blog プラトン『法律』第九巻メモ(2) プラトン『法律』(プラトン全集 (岩波) 第13巻) 第九巻を読んだときのメモ第2弾です。 前半の (1) では，神殿荒しに始まり，不正を犯した人間に与える罪について色々言われていました。特に不正というのは，故意によるものか，そうではないのか，ということで異なるのか？という議論など，刑事罰の根本的なことが言われて面白かったところです (勿論量刑的なところは現代とあまりにかけ離れていますが)。 後半はその続きで，では具体的に殺人事件や傷害事件における罰則はどういうものにすべきかが述べられます。そのため単調な感じもあるところですが，動物を裁判にかけるという話など，サラッと度肝を抜くような話が出てきたりします。 以下読書時のメモと引用です。第7章以前は メモ(１) を参照。 (第8章) 以下の数章では，(A) 故意によらず殺人を犯した場合，(B) 激情にかられて (計画性なく) 殺人を犯した場合，(C) 故意に (計画的に) 殺人を犯した場合，の大きく3通りに分けて，罰則を定めた法律が述べられます。そういうわけなので，引用して感想を述べる，というスタイルは難しいので，大雑把なまとめと感想を述べるようにします。正確な内容は，本を参照してください。 (A) 故意によらず殺人を犯した場合 このケースは，競技中，戦争中，軍事訓練中，医者が患者の治療を行っている時，という場合が挙げられています。 また，殺した相手が，他人の奴隷である場合 / 自分の奴隷である場合 / 自由民の場合 / 外国人の場合，で分かれています。 内容的には，第6章で言われていたように，故意ではないため「不正」ではなく，浄めを受け賠償は行うが死刑にはならない，という感じです (なので相手が自分の奴隷だったら賠償の必要はないみたいなことも言われます)。但し相手が自由民や外国人の場合は，1年間は被害者の住んでいた土地から離れなければいけない，ということも入っています。
